At the end of the processing period your data will be deleted or destroyed.

4. Access to data

Your data may be made accessible for the purposes referred to in the art. 2.A) (contractual obligations) and 2.B) (advertising communications):

• to employees and collaborators of the Data Controller or of Group companies in Italy and abroad, in their capacity as internal data processors and/or managers and/or system administrators;
• to third-party companies or other subjects (for example, credit institutions, professional firms, consultants, etc.) who carry out outsourced activities on behalf of the Data Controller, in their capacity as external data controllers.

5. Data communication

Without the need for express consent (art. 6 letter b) and c) GDPR), Fratelli Di Martino S.r.l. may communicate your data for the purposes referred to in the art. 2.A) to supervisory bodies, judicial authorities, as well as to those subjects to whom communication is mandatory by law for the fulfillment of the aforementioned purposes. These subjects will process the data in their capacity as independent data controllers. Your information will not be disseminated.

6. Data transfer

Personal data is stored on servers located in Italy, within the European Union. In any case, it is understood that the Owner, if necessary, will have the right to move the servers even outside the EU. In this case, Fratelli Di Martino S.r.l. hereby ensures that the transfer of non-EU data will take place in compliance with the applicable legal provisions, subject to the stipulation of the standard contractual clauses provided by the European Commission.

7. Nature of providing data and consequences of refusing to respond

The provision of data for the purposes referred to in art. 2.A) is mandatory. In their absence, we will not be able to guarantee the Services referred to in the art. 2.A).

The provision of data for the purposes referred to in art. 2.B) is instead optional. Consent may be given by signing the specific information. You can therefore decide not to provide any data or to subsequently deny the possibility of processing data already provided: in this case, you will not be able to receive newsletters, commercial communications and advertising material relating to the products and services offered by Fratelli Di Martino S.r.l.. You will however continue to be entitled to the Services referred to in the art. 2.A).

Rights of the interested party

In your capacity as an interested party, you have the rights referred to in the art. 15 GDPR and precisely the rights of:

1. obtain confirmation of the existence or otherwise of personal data concerning you, even if not yet registered, and their communication in an intelligible form;
2. get the indication:
   1. of the origin of the personal data;
   2. of the purposes and methods of processing;

• of the logic applied in case of processing carried out with the aid of electronic instruments;

1. the identification details of the owner, managers and representative designated pursuant to art. 3, paragraph 1, GDPR;
2. of the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them in their capacity as designated representatives in the territory of the State, managers or agents;

• get:
  1. updating, rectification or, when interested, integration of data;
  2. the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including those whose retention is not necessary in relation to the purposes for which the data were collected or subsequently processed;
  3. the certification that the operations referred to in letters a) and b) have been brought to the attention, also with regard to their content, of those to whom the data have been communicated or disseminated, except in the case in which such fulfillment proves impossible or involves the use of means that are manifestly disproportionate to the protected right;

1. oppose, in whole or in part:
   1. for legitimate reasons to the processing of personal data concerning you, even if pertinent to the purpose of the collection;
   2. to the processing of personal data concerning you for the purposes of sending advertising or direct sales material or for carrying out market research or commercial communication, through the use of automated call systems without the intervention of a operator via e-mail and/or via traditional marketing methods via telephone and/or paper mail. Please note that the interested party’s right of opposition, set out in the previous point b), for direct marketing purposes using automated methods, extends to traditional ones and that in any case the possibility for the interested party to exercise the right of opposition also remains only partially. Therefore, the interested party can decide to receive only communications via traditional methods or only automated communications or neither of the two types of communication.

Where applicable, you also have the rights referred to in the articles. 16-21 GDPR (Right of rectification, right to be forgotten, right to limit processing, right to data portability, right to object), as well as the right to complain to the Guarantor Authority.
